A round up of news from the BASDA SIGs
HR & PAYROLL SIG:
The Diligence against Earnings (Variation) (Scotland) Regulations 2009
This was due to come into force on the 6th April 2009, but after objections from BASDA this act has been withdrawn. The changes replaced the existing table of earnings bands with a single percentage. The Scottish Parliament will now discuss with the Payroll Community about bringing in the changes at a later date which is more suitable to us all. This is the first time that the software industry has managed to over turn the attachments orders.
HMRC Free Software
HMRC are reviewing their position in supplying free software, and have issued a document to the software developers to say that if enough suppliers produce a free product they will withdraw from the market.
BASDA and BCS produced a document to outline what was to be included in the free software, the document was titled ‘Straw man’ and is available from the HR&Payroll SIG forum area.

FINANCIALS SIG:
Change To EC Sales List Format – Effective January 2010
Please note that HMRC are proposing to make changes to the EC Sales List format effective from 1st January 2010. This is a result of the changes to VAT for intra-EU services but will affect all traders who submit an EC Sales list from their accounts software. HMRC have yet to provide a detailed spec for the changes to the electronic submissions but have committed to providing a test service in October of this year. HMRC have stated that they will canvas developers for their lead-times on delivering this change when they circulate a "Tech Pack" of the changes. However, it looks like 1st Jan 2010 will be an immovable date and that there will be pressure on developers to deliver these changes to all their customers who sell to the EC.
Running out of VAT Numbers !
HMRC advised that using the current check digit algorithms that they will expect to run out of VAT numbers in 2010. As a consequence of this they will need to introduce a new algorithm for validating the new format VAT numbers. If your software application uses the current check digit technology to verify VAT number entry then there will be a need to make changes in 2010. The new "Modulus 9755" has been published by HMRC and is available from HMRC via the SDTS team. This modulus will be an additional check to apply if the initial check digit check fails.
On Line VAT 100 Submissions
HMRC have advised that they will be providing a full test service for the on line submission of the VAT 100 return in August 2009. Live submissions can then be made in October 2009 with the mandatory filing of VAT 100s on line coming into effect from April 2010. Mandatory filing of the VAT 100 on line will apply to all newly registered businesses or any existing business with a turnover exceeding £100,000 p.a. Traders will also be obliged to make their payments to HMRC electronically.

GREEN SIG:
Momentum & visibility for the BASDA Green Charter at European level
I recently represented BASDA at a major European Commission event on ICT and Energy Efficiency. I also chaired a packed breakout session at the event and was able to announce the latest signatory to the BASDA Green Charter, SAP.
The message BASDA has been pushing for over 18 months – that the focus should not only be on ICT’s 2% contribution to carbon emissions but on the greater contribution we can make to reducing the other 98% by enabling reductions by other industries - has been embraced wholeheartedly by the European Commission. The Commissioner for ICT, Viviane Reding, who opened the Brussels event has further endorsed this in a press release and video message on March 30th, but she is also looking for the ICT sector to set the pace. She says, "We clearly need a 'New Green Deal for Europe'. [...] I would recommend the ICT sector to lead the way for the rest of the economy by reducing its own carbon footprint by 20 percent as early as 2015."
Importantly the Commission has begun a public consultation on how ICT can help drive the move to a low carbon society and how this should be reflected in EC policy in the Autumn. This is open until June 14th. All BASDA Green Charter signatories should take the opportunity to complete the short online questionnaire to make their views and requirements known.
This acceptance of the central role ICT plays was viewed by attendees at the Brussels event as a major step forward for the European Union – and BASDA is once again at the heart of the debate."

BASDA is working together with other industry representatives and HMRC on the CIS Operational Forum. We have helped identify some potential future enhancements to the operation of the CIS tax scheme.
